Home Depot files petition with higher court amid dispute with Wilsonville

Home Depot is not contesting the Oregon Court of Appeals decision preventing its use of the former Fry's Electronics building. 

After its arguments were rejected by the Land Use Board of Appeals, Home Depot wants the Oregon Court of Appeals to consider its dispute with the city of Wilsonville regarding a land use application it submitted to place a store at the former Fry’s Electronics building in Town Center.

LUBA’s opinion, released Tuesday, Oct. 1, affirmed the city’s decisions regarding the legal status of the former Fry’s Electronics building and the denial of Home Depot’s proposed use of the building. LUBA consolidated these matters into one opinion, but Home Depot filed petitions for each with the Oregon Court of Appeals. The court of appeals is the second highest judicial body in the state behind the Oregon Supreme Court.

Home Depot’s latest appeal follows a months-long dispute with the city as it has attempted to move into the former Fry’s Electronics building. The city has repeatedly denied Home Depot’s appeals, saying that the company’s use of the building would not comply with the city code. Fry’s Electronics closed in 2021 and the site has been vacant since then. The city wants the location to align with its vision of Town Center as a more walkable area with fewer large parking lots.
